I think your statement is incomplete. Let's say the colors are A and B (e.g. amber and blue) and h=2. Initial piles are (top to bottom) A1, A2 and B1, B2. Then the new piles (bottom to top) A2, B1 and B2, A1 match your conditions but can not be obtained using the original rules. The reason is that there is a cycle formed by cards in the same new pile and consecutive cards of the same color: A2 -(pile)-> B1 -(color)-> B2 -(pile)-> A1 -(color)-> A2
