I think your statement is incomplete. Let's say the colors are A and B (e.g. amber and blue) and h=2. Initial piles are (top to bottom) A1, A2 and B1, B2. Then the new piles (bottom to top) A2, B1 and B2, A1 match your conditions but can not be obtained using the original rules.
